online ordering. We ask for only the personal information we
deem necessary to process a customer’s order. We guarantee
that the information you submit to us will not be shared, sold,
or released to any other parties.
We fully cooperate with law enforcement agencies in identifying
those who use this site for illegal activities. As such, we reserve
the right to report to law enforcement agencies activities that
we reasonably believe may be unlawful.

Typographical Errors
Information on this web site describing items and prices of
items is reliable but not guaranteed. When ordering, please verify
all important information. Although we make every effort to correctly
price each item, if a product is listed with an incorrect price
due to a typographical error, we may exercise our right to refuse
or cancel any orders placed for any product listed at the incorrect
price. If your credit card has already been charged for the item,
we will gladly issue a credit to your credit card in the amount
of the incorrect price.

for content located on or through web sites other than our own.

If a problem arises related to your order, we will work with
you, quickly and courteously, to determine the action to be taken
to remedy the problem.
Pricing
All prices are in United States dollars and are subject to change
without prior notice.
Shipping & Handling Fee
Items weighing more than 150 pounds will be quoted separately.
Extra shipping charges may apply to orders destined for outside
the continental US ( i.e., Alaska, Hawaii, Puerto Rico, or any
location outside of the continental US.)
Please see our order confirmation for extra shipping charges
or inquire before placing your order. Orders requiring extra
freight charges cannot be processed until you approve the amount
on the final invoice.
Ordering
You may place your order online using our SSL secure online
shopping cart, or by using fax or mail orders.
We will email an order confirmation to you within 24 hours of
receiving your order, except on holidays or weekends. The order
confirmation will list each item, its unit price, and the total
amount of your order and will quote extra shipping charges, if
applicable. We will charge a restocking fee and shipping charges
as outlined under Returns and Exchanges for any order placed
then subsequently cancelled and/or refused for delivery by you.
By sending an order to us you make an offer to purchase, which
we will consider open for a reasonable time or no more than 30
days. Shipping the item ordered constitutes our acceptance of
your order. We have the right to accept or decline your order
for any reason and, without prior notice to you, to supply less
than the quantity you ordered.
We may need additional verification
before we accept any order.
Payment
We accept payment by Visa, MasterCard, and Money Orders.
All credit card payments are processed on the day we receive
the order.
Shipping & Handling Policy
We will process all orders from you as soon as possible and
will ship from the warehouse closest to you, as we determine
and depending upon stock availability. (Normal interval before
shipping is 24 to 48 hours.)
Unless otherwise specified, all orders are shipped
via UPS Ground, FedEx Ground, or common carrier. We cannot deliver
to a P.O. Box, as per shipper restrictions. We do not ship on
weekends or holidays. We will offer premium shipping delivery
at customer's expense.
Back Orders
We will place any items temporarily out of stock on back order
and ship to you as soon as they become available. We will notify
you of any notable delays.
Damage Claims
We will provide that all shipments are properly insured for
the full replacement value of the goods shipped. The carrier
bears the responsibility for safe delivery after we or our supplier
have placed the order for shipment. Please follow these steps
when receiving an order from a courier or trucking company:
1. Open all boxes, check the contents immediately in the presence
of the carrier’s agent (UPS driver, etc.). Report to the
agent any damages or variations from the order (missing parts,
crushed box, etc.) by filling out a damage report on their bill
of lading. It is your responsibility to inspect the goods before
signing for them and initiate a claim with the shipper if a problem
exists. We cannot file a claim on your behalf.
2. We will work with you and assist you with any action that
needs to be taken.
3. All damages discovered at a later date are ultimately your
responsibility, since after the shipment has been accepted by
you, it is practically impossible to initiate a damage claim.
Returns & Exchanges
You may return all items (*some exceptions
apply - see below) within 10 days after receiving your order
for exchange, refund, or an in-store credit if you are not
satisfied with your purchase. Shipping and handling charges
are not refundable. We ask you to pay our expenses for shipping
the item to you and return shipping charges to our warehouse.
If we erroneously ship the wrong product, we will cover all
Ground shipping charges involved.
Before returning any item, contact us for a return merchandise
authorization number. We will then tell you what warehouse to
return the merchandise to. We must have a RMA number to be able
to accept your return. Please include a copy of your order confirmation/invoice
and clearly mark the RMA number on the outside of each shipping
carton, rather than on the product packaging. Without prior authorization
from us, any shipment returned to us will be returned to you.
Wrap items securely and return them prepaid and properly insured.
We will refuse items sent freight collect and return them to
you.
Be sure all returned items are in their original sealed boxes
or packaging, are unused, and are in condition to be resold.
No items that are used, worn, damaged, dirty, or with torn packaging
will be accepted.
Items Not Returnable: Sale items and specials, special orders,
pond liners, felt underlay, tubing, water additives, conditioners,
pond treatment and chemicals of any kind, fish food and medications,
plant food, and books.
Disclaimer & Limitation of Liability

Aqua Scapes of Arkansas, LLC makes no representations or warranties
with respect to this site, its operation, contents, information,
and/or materials, and disclaims all representations, conditions,
and/or warranties expressed or implied, of any kind, concerning
this site and its use. You agree that Aqua Scapes of Arkansas,
LLC shall not be liable for any damages arising from the operation,
content and/or use of this site. You further agree that the limitation
of liability is comprehensive and at maximum, does not exceed
the original purchase price of the product ordered.
Manufacturer’s Warranty Claims
All products sold by Aqua Scapes of Arkansas,
LLC are new, in their original packaging, and are warranted
by the manufacturer to the user against defective material
and workmanship under normal use for the period as specified
by the corresponding manufacturer’s
warranty, where applicable. The seller and manufacturer’s
only obligation to the buyer and user for any breach of warranty
shall be for the manufacturer to replace or repair, at its discretion,
any part or product found to be defective in material or workmanship
during the warranty period.
Proof of purchase (invoice copy) is required on
all claims. The defective product or part must be returned to
our warehouse, freight prepaid, along with proof of purchase.
All returned items will be inspected to determine the cause of
failure. Please note the warranty does not cover return shipping
charges to the buyer/user.

Aqua Scapes of Arkansas, LLC disclaims all warranties, expressed
or implied, including any implied warranties of merchantability
and fitness for a particular purpose. Aqua Scapes of Arkansas,
LLC will not be liable for any damages of any kind arising from
the use of this site, including without limitation direct, indirect,
incidental, punitive, and consequential damages. You agree that
the maximum cumulative liability of Aqua Scapes of Arkansas, LLC
arising from the use of this site and/or from the purchase and/or
use of the products offered and sold will not exceed the original
purchase price of the product ordered.
Please adhere to your local bylaws. Carefully read operating
instructions from the manufacturer and follow their recommendations.
All 120 Volt electrical equipment used indoors or outdoors must
be plugged into a properly grounded and GFCI (ground fault circuit
interrupter) protected 120 Volt outlets only. This is a requirement
and is for your own protection. If in doubt, consult a licensed
electrician. An approved transformer must be used for all low-voltage
equipment.
Court of Jurisdiction
You agree that any legal action
brought against Aqua Scapes of Arkansas, LLC will be governed
by the laws of the State of Arkansas with regard to its conflict
of laws principles. You agree that the sole jurisdiction and
venue for any litigation arising from your use of this site or
purchases made from us shall be an appropriate court located
in the state of Arkansas. You agree that any legal action brought
by you shall be individually. The parties agree that the United
States Convention of Contracts for the International Sale of
Goods does not apply to the sale of any products by Aqua Scapes
of Arkansas, LLC or to this Agreement.
